Terms of Use

These Terms of Use ("Terms") form an agreement between you and Lemonshark Games ("Lemonshark", "we", "us" or "our") governing your use of the mobile games and applications we publish for iOS and Android (each, an "App") and our website at lemonsharkgames.com. By downloading, installing or using an App, you agree to these Terms. If you do not agree, do not use the App.

1. Licence

Subject to these Terms, Lemonshark grants you a personal, limited, non-exclusive, non-transferable, revocable licence to download and use the App on any Apple-branded or Android device that you own or control, solely for your personal, non-commercial entertainment. This licence is governed by the Apple Licensed Application End User Licence Agreement ("Apple Standard EULA") where the App is obtained from the App Store, except as expressly varied by these Terms. 2. Acceptable use

You agree not to:

• copy, modify, reverse-engineer, decompile or create derivative works of the App, except where permitted by law;
• rent, lease, lend, sell, redistribute or sublicense the App;
• use the App for any unlawful purpose or in violation of these Terms;
• attempt to gain unauthorised access to, interfere with, or disrupt the App or any related systems.

3. Intellectual property

The App and all content within it — including code, artwork, characters, audio, names and logos — are owned by Lemonshark or its licensors and are protected by intellectual-property laws. Except for the licence granted above, these Terms transfer no rights in the App to you. "Lemonshark Games" and our logo are our trademarks.

4. Purchases

If an App offers paid content or in-app purchases, those transactions are processed by Apple or Google under their terms, not ours. Any refunds are handled according to the policies of the App Store or Google Play. We do not store your payment details.

5. Advertising

Our Apps display advertisements provided by third-party advertising networks. The presence, frequency, and type of ads may change at any time. Optional "remove ads" purchases remove only the ad formats stated at purchase (rewarded videos you choose to watch may remain available).

6. Virtual items and currency

Our Apps may offer virtual coins, boosters, or other virtual items. Virtual items have no real-world value, cannot be exchanged for money or anything of value outside the App, and are non-transferable. Purchases of virtual items are final, subject only to the refund policies of Apple or Google. Virtual items may be lost if you delete the App or if your access is terminated for breach of these Terms, and we are not liable for such loss.

7. Subscriptions

Some purchases are auto-renewing subscriptions. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period, and are charged and managed through your Apple or Google account settings, where you can cancel at any time. Deleting the App does not cancel a subscription.

8. Game progress

Progress is saved on your device and may sync via your platform account (e.g., iCloud). We do not guarantee that progress, virtual items, or scores will always be preserved, and we are not liable for lost progress, including after reinstalls, device changes, or service interruptions.

9. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we and our advertising partners handle data.

10. Disclaimer of warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the App will be uninterrupted, error-free or free of harmful components. You use the App at your own risk, to the maximum extent permitted by law.

11. Limitation of liability

To the maximum extent permitted by law, Lemonshark will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, profits or goodwill, arising out of or relating to your use of (or inability to use) the App. Our total liability for any claim relating to the App will not exceed the amount you paid us for that App, if any.

12. Termination

These Terms apply until terminated. Your licence ends automatically if you breach these Terms. You may end it at any time by deleting the App. On termination, you must stop using and delete the App.

13. Apple and Google as third-party beneficiaries

Where you obtain an App from the Apple App Store, you acknowledge that these Terms are between you and Lemonshark only, and not with Apple. Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms and, upon your acceptance, will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary. Apple has no obligation to furnish maintenance or support for the App and is not responsible for addressing any claims relating to the App. The equivalent applies to Google where the App is obtained from Google Play.

14. Governing law

These Terms are governed by the laws applicable at Lemonshark's principal place of business, without regard to conflict-of-laws rules, and subject to any mandatory consumer-protection rights you have where you live.

15. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and post the new version here. Continued use of an App after changes take effect means you accept the revised Terms.
